MITTEILUNG

ÜBER ANTRAG AUF EINSTWEILIGES VERFÜGUNG





     Hiermit Ihnen wird gemäß Paragraph 527(c) der Zivilprozeßordnung des


Bundesstaates Kalifornien, Paragraph 379 der kalifornischen Gerichtsvorschriften


und der örtlichen Vorschrift 1.3.5. des Landgerichts des Kreises Santa Clara des


Bundesstaats Kalifornien mitgeteilt, daß DVD Copy Control Association, Inc.


("DVD CCA") am 29. Dezember 1999 um 8.30 Uhr entweder in Abteilung 2, 9 oder 12


des Landgerichtes des Kreises Santa Clara, Bundesstaat Kalifornien, einen Antrag


(ohne Anhörung der Gegenpartei) auf Erlaß einer einstweiligen Verfügung und


einen Antrag, Einwendungen gegen eine beabsichtigte Anordnung des Gerichts


vorzubringen, stellen wird. Die Anschrift des Gerichts lautet: 191 North First


Street, San Jose, CA. Die Klage wird spätestens bis 8.30 Uhr an diesem Tag


eingereicht werden und die Sache wird entweder der Abteilung 2, 9 oder 12


zugewiesen werden. Ein Vertreter von DVD CCA wird außen vor allen drei


Abteilungen warten und sich Ihnen gegenüber als Vertreter von DVD CCA ausgeben.


     Dieser Antrag hat zum Ziel, Ihnen (und denjenigen, die mit Ihnen oder für


Sie arbeiten), zu untersagen, firmeneigene Informationen, Eigentum oder


Geschäftsgeheimnisse von DVD CCA, einschließlich, ohne darauf beschränkt zu


sein, des DeCSS-Programms oder anderer Programme, die firmeneigene Informationen


enthalten, die die Entschlüsselung von Daten auf DVD-Disketten ermöglichen oder


dafür geschaffen wurden, weiterhin zu benutzen oder anderweitig offenzulegen


oder auf Ihren Websites oder an anderen Orten zu vertreiben oder Verbindungen zu


anderen Websites herzustellen, die diese offenlegen, vertreiben oder zu


denselben Verbindungen (?Links?) herstellen.


     DVD CCA wird Ihnen eine Mitteilung über die Anordnung, die das Gericht


hinsichtlich des von DVD CCA gestellten Antrags auf eine einstweilige Verfügung


erlassen wird, an Ihre Web-Adresse und, soweit bekannt, an Ihre Postanschrift


durch die amerikanische Bundespost zustellen, einschließlich eventueller


zukünftiger Gerichtstermine.


In der Anlage erhalten Sie die Klage, die gegen Sie eingelegt wird in englischer
Sprache und in der Landesprache, in der Sie Ihre Website zu betreiben scheinen

NOTICE OF APPLICATION FOR TEMPORARY RESTRAINING ORDER


          Notice is hereby given pursuant to California Code of Civil Procedure,


section 527(c), California Rule of Court 379, and Local Rule 1.3.5 of the Santa


Clara Superior Court of the State of California that the DVD Copy Control


Association, Inc. ("DVD CCA") is filing an ex parte application for the issuance


of a Temporary Restraining Order and an Order to Show Cause re: Preliminary


Injunction in Department 2, 9 or 12 of the Superior Court of Santa Clara County,


State of California, on December 29, 1999, at 8:30 a.m.  The address of the


Court is 191 North First Street, San Jose, CA.  A Complaint will be filed no


later than 8:30 a.m. on that day and the matter will be assigned either to


Department 2, 9, or 12.  A representative of DVD CCA will be outside all three


departments and will identify himself to you as a representative of DVD CCA.


          The Application will seek to enjoin you (and those working with or for


you) from making any further use or otherwise disclosing or distributing on your


web site or elsewhere, or linking to other web sites which disclose, distribute


or link to, any proprietary information or property or trade secrets of DVD CCA,


including, but not limited to, DeCSS or any program which includes proprietary


information which is designed to, or enables one to, decrypt data on DVD discs.


          DVD CCA will provide you with further Notice at your web site address,


and to the extent that we know it, to your street address via the United States


postal system, of the Order issued by the Court regarding DVD CCA?s Application


for a Temporary Restraining Order, including the dates of any further hearing


set by the Court.


          Please find, as an attached file, the Complaint being filed against


you both in English and in the language of the country in which your web site


appears to be based.
